Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the dot8 mobile application, the dot8 hardware companion features, and related services (collectively, the “Service”) provided by dot8 (“dot8”, “we”, “our”, or “us”). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Account

Some features require you to create an account using Google Sign-In. You are responsible for keeping your credentials secure and for all activity that occurs under your account. Notify us immediately at khazana@pw.live of any unauthorized use.

3. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on devices you own or control, for personal, non-commercial use, solely as intended by the Service.

4. User Content

You retain ownership of pixel art, designs, images, and other content you create or upload through the Service (“User Content”). You grant dot8 a worldwide, royalty-free, non-exclusive license to host, store, reproduce, modify, and display User Content solely to provide and improve the Service. You are responsible for ensuring you have the rights to any content you submit.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law;
• Upload or share content that infringes intellectual property, privacy, or other rights;
• Upload or share content that is obscene, harassing, hateful, or otherwise objectionable;
• Reverse engineer, decompile, or attempt to extract the source code of the App or related firmware, except to the extent permitted by law;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service, related networks, or other users’ accounts;
• Use automated means to access or use the Service without our written permission.

6. Hardware and Firmware

The Service interfaces with dot8 hardware over Bluetooth. You are responsible for the proper operation, charging, and maintenance of your hardware. We may release firmware or App updates from time to time. Some updates may be required for continued use of the Service.

7. Intellectual Property

Except for User Content, all rights, title, and interest in and to the Service, including the App, firmware, designs, logos, and trademarks, are and will remain the exclusive property of dot8 and its licensors. These Terms do not grant you any right to use any dot8 trademarks without our prior written consent.

8. Third-Party Services

The Service may integrate with third-party services (for example, Google Sign-In). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, in no event will dot8, its affiliates, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars (USD 100).

11. Indemnification

You agree to indemnify and hold harmless dot8 and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason in our reasonable discretion. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

13. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. If we make material changes to the Terms, we will notify you through the App or by other reasonable means. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. The courts located in India will have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Service, except where prohibited by applicable law.
